Tom Brady’s lawyer says he’ll file for a stay of the QB’s suspension if legal battle drags on

There’s still a chance Tom Brady plays in the first four games of the 2016 season.

The 2nd Circuit Court of Appeals reinstated the Patriots quarterback’s four-game suspension on April 20 for his role in the Deflategate scandal. But Brady’s legal team announced Monday it will file a petition for a rehearing with hopes of having the suspension overturned. The legal battle could continue through the summer and perhaps into the start of the 2016 season.

In that event, Brady’s legal team could file a “stay” to prevent Brady from serving the four-game suspension before the legal action finishes. On Monday morning, Brady’s lawyer Ted Olson was asked about the possibility of a “stay” on ESPN’s “Mike and Mike” radio show.

“If it is necessary, if it pushes back into close to the beginning of the season, of course we would consider, and probably apply for a stay,” Olson said. “And I would think the court would grant it, freeze the status quo, and allow things to continue until the decision on the merits is made. That’s getting far ahead of where we are now. We do expect that the full second circuit court of appeals will rule on this expeditiously.”
