Prosecutors dropped all charges against a man accused of an attempted bank robbery in Swansea last month, court records show.
29-year-old Giovany Fouyolle of Randolph was facing eight charges in Fall River District Court, including armed robbery, assault and battery, kidnapping, and more. All charges were dropped on Thursday.
Two men allegedly flashed a gun and tried to rob a courier who was making a drop at BayCoast Bank on Swansea Mall Drive on Feb. 19, Swansea police said. The bank was closed for President’s Day.
Swansea police said the two men fled on Reed Street in a Jeep, and Rhode Island State Police stopped a Jeep matching the description and arrested Fouyolle. He was the only person in the car.
In court, the courier said at least $37,000 was stolen during the robbery, but Fouyolle’s defense attorney said he was “nowhere near” Swansea at the time, WPRI reported.
“There is a significant difference we believe in the two types of vehicles,” the defense attorney said in court. “The one my client was stopped in and the one that was used in the robbery.”
Swansea police said on Monday night that there is a “very active investigation” into the attempted bank robbery since the charges against Fouyolle were dropped. A spokesperson for the Bristol County District Attorney’s office released a statement to WPRI.
“After careful review of the evidence that included surveillance video, it has been determined this individual was not present during the commissioning of the crime,” spokesperson Gregg Miliote told WPRI.
