New Hampshire man convicted of killing college student to have appeal heard

The New Hampshire Supreme Court will hear an appeal from a man convicted of strangling and raping a New Hampshire University student lured into his apartment by his girlfriend.

Prosecutors and attorneys for Seth Mazzaglia will give oral arguments in front of the court on June 22.

Mazzaglia was convicted last year of first-degree murder and is serving life without parole for the death of Elizabeth Marriott on Oct. 9, 2012. Prosecutors said that Mazzaglia was furious that Marriott wouldn’t have sex with him and strangled her from behind. The couple then dumped the body stuffed in a suitcase in a Portsmouth river.

Mazzaglia’s then-girlfriend, Kathryn McDonough, was convicted of her role in Marriott’s death. She is scheduled to be released in July.

Defense attorneys maintained during trial that Marriott died accidentally during a consensual sexual encounter that involved bondage.

In their appeal, Mazzaglia’s defense says the jury should have heard undisclosed information about Marriott, which is redacted in the brief submitted to the court.
