Authorities ‘overreacted’ with multi-state Amber Alert, lawyer says

The defense attorney for a mother who drove her sick son against medical advice from Pennsylvania to Boston for treatment said Monday in court authorities overreacted when they issued a multi-state Amber Alert for his client.

“I think this is totally overblown,’’ Defense Attorney Stephen Weymouth said to The Boston Globe outside the courthouse. “Pennsylvania overreacted. I don’t think this was a proper use of the Amber Alert.’’

Tiffany Cherry, the mother of the seriously ill infant, pleaded not guilty in Roxbury Municipal Court Monday on a charge of endangering a child, according to the Globe.

The charge was filed by Pennsylvania authorities after Cherry went against the advice of a nurse practitioner at Geisinger Kistler Clinic in Wilkes-Barre, Pennsylvania, on Friday. Instead of taking her 2-month-old son to a nearby ER, she drove more than five hours to have him treated at Boston Children’s Hospital, where she was arrested.

Cherry also was arraigned Monday on charges from warrants issued in 2002 and 2010 related to prostitution and motor vehicle violations in Dorchester and Somerville, the Globe reported.

Judge David Poole set bail her at $250 cash, according to the report. Cherry’s infant son has been placed in the custody of the state Department of Children and Families, the Globe reported.
