Appeals Court Will Hear Arguments to Move Tsarnaev Trial
A federal appeals court said it will hear arguments about whether to relocate the trial of Dzhokhar Tsarnaev out of Boston, The Boston Globe reports. The arguments are scheduled for February 19 at 10 a.m. and will be public.
Jury selection in the trial will continue as planned.
Tsarnaev’s defense team has argued that the trial must be moved out of the area in order to find an impartial jury. U.S. District Court Judge George O’Toole Jr. has rejected that request three times, most recently last week.
The federal appeals court previously denied the defense’s challenge of O’Toole’s decision in early January by a 2-1 vote, with Judge Juan Torruella the lone opposing vote. Torruella requested next Thursday’s oral arguments, which only need one judge’s approval to be held, according to The Globe.
