A Brockton man is facing more than a dozen assault and firearm charges after a shootout between him and two police officers over the weekend, records show.
Jailson Andrade, 44, was arraigned Tuesday in Brockton District Court on 14 charges, including two felony counts each of assault to murder, assault with a dangerous weapon, and carrying a firearm without a license. He was ordered held without bail pending a dangerousness hearing, court records show.
Andrade was allegedly involved in a shooting with Brockton police officers after they pursued him for an attempted traffic stop, according to a police report filed in court. Just before 2 a.m. Sunday, the officers were patrolling Montello Street when they spotted a parked white Lexus they recognized from a police bulletin.
The department-wide notice cited Andrade, who was registered as the car’s owner, as a party of interest in an ongoing shooting investigation, the report said. A short time after the officers noticed the vehicle, Andrade returned to it and drove off to the intersection of Main and Pleasant Streets.
The officers then witnessed Andrade make an “unsafe lane change” onto Pleasant Street, prompting them to turn on their emergency lights and sirens for a traffic stop, according to the report. Andrade allegedly slowed down at first, but then sped up, blowing past several stop signs and reaching estimated 70 mile-per-hour speeds in a 30 mile-per-hour zone.
At the intersection of Spring and Moraine Streets, Andrade then “lost control of the vehicle” and stopped in the middle of the road, the report said. When the officers approached his car, they saw him reach for a possible weapon.
Andrade allegedly ignored one of the officer’s commands to stop reaching, got out of the car, brandished a firearm, and began firing over the roof of the Lexus. The officers returned fire and struck him once in the shoulder.
After the Brockton officers restrained Andrade, more officers arrived on the scene and gave him medical aid. On the ground, they found a 9mm Luger semi-automatic pistol with “an obliterated serial number,” which was later seized by Massachusetts State Police, according to the report.
A 71-year-old man who was sleeping in a nearby home on Moraine Street was grazed by a round fired during the shootout. Both he and Andrade were taken to Boston Medical Center in Brockton with non-life threatening injuries.
Prosecutors found that Andrade had a “plethora of violent offenses” on his record, including assaults with a dangerous weapon, assaults on police officers, breaking and entering, and destruction of property, according to the police report. He was allegedly carrying his weapon without a license and would not legally have been able to obtain a license due to these prior offenses.
State Police detectives assigned to the Plymouth County District Attorney’s Office are actively investigating the shooting. Andrade is due back in court May 1 for a dangerousness hearing, according to court records.
Andrade’s attorney, Maximilian Martucelli, did not immediately respond to a request for comment Tuesday night.
